Welcome to Shameless! These Terms of Service ("Terms") govern your access to and use of our mobile application ("Shameless App"), website, and WebApp located at https://shameless.app (collectively, the "Services"). By using Shameless, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our Services.

1. Who We Are

2. Eligibility

You must be at least 18 years old to use Shameless. By using our Services, you confirm that you meet this age requirement.

3. End User License Agreement (EULA)

By downloading or using the Shameless mobile application via the Apple App Store, you agree to be bound by Apple's standard End User License Agreement (EULA), available here:

4. Subscription Terms / Payment Policy

Shameless offers access to premium content and features through paid subscription plans. By purchasing a subscription, you agree to the following terms:

a. Payment Methods

• iOS App: Subscriptions are billed through Apple In-App Purchases and managed via your Apple ID.
• WebApp: If applicable, web-based purchases may be processed securely through Stripe.

We do not store your payment details. All payment processing is handled by Apple or Stripe.

b. Auto-Renewal

All subscriptions are set to automatically renew at the end of each billing period (monthly or yearly), unless canceled at least 24 hours before the renewal date.

You can manage or cancel your subscription via:

• iOS: App Store > Your Profile > Subscriptions
• Web: (if applicable) via the account settings on shameless.app

c. Trial Periods & Promotions

We may offer free trials or promotional pricing from time to time. After the trial ends, you will be billed unless you cancel before the trial period expires.

d. Refund Policy

• Apple Payments: All refunds for purchases made through the App Store must be requested through Apple Support.
• Web Payments: If you purchased via the website and are unsatisfied, please contact us at support@shameless.app within 7 days of your purchase. Refunds are granted at our discretion.

e. Price Changes

We reserve the right to change pricing at any time. If prices increase, you will be notified by Apple or through email/in-app notification and given the option to accept or cancel before your next billing cycle.

5. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate information
• Keep your login credentials confidential
• Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

6. Acceptable Use

You agree not to:

• Use the app for any unlawful or harmful purpose
• Reproduce, distribute, or modify our content without permission
• Interfere with security-related features or access accounts you don't own

We reserve the right to ban users who violate these guidelines.

7. Content Ownership

All content, branding, and features of Shameless are owned by LottaProjects or licensed to us. Users may not use any part of the platform's content for commercial purposes without permission.

8. User Content

If you upload or save content (e.g., favorites, notes), you retain ownership, but you grant us a license to store and display it as part of providing the service.

9. Analytics & Data Collection

We use PostHog and Amplitude to track user behavior for the purpose of improving our services. More details are available in our Privacy Policy.

10. Service Availability

We strive to keep our services online, but we cannot guarantee uninterrupted access. We may suspend or modify parts of the service at any time for maintenance or technical reasons.

11. Termination

You may stop using Shameless at any time. We may suspend or terminate your access if:

• You violate these Terms
• We are required by law to do so
• The service is discontinued

12. Limitation of Liability

To the fullest extent permitted by law, LottaProjects is not liable for:

• Any indirect, incidental, or consequential damages
• Loss of data, profits, or reputation
• Technical issues or outages

Your use of the Services is at your own risk.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on our website and, if significant, we'll notify you via email or in-app notification.

14. Governing Law

These Terms are governed by the laws of Germany, without regard to its conflict of law principles.
